Oneyed, that is not a losing condition, that is just a negative bonus.
But you are correct in saying that if you do not hold a capital you can have a bonus of minus 1.
As for the second one, not sure if I understand, Do you want a territ to lose 1 each turn and then also a second one if you do not hold a capital. This is not possible.
You can give each region you want a decay of 1 so it loses 1 every turn and a negative bonus of minus 1. The negative bonus will only effect the troops you can deploy though.

Not sure but if I read him correctly, he wants decays (which are constant) to get larger without a capital. That cannot be done now.
