Just cuz when playing with family it feels more normal to use "names" not top dog, poocho.... so on... maybe like battle royals/tournys are excluded cuz people wanna see what's going on...

Nope.
Tournaments run on Private Games. There is still way too much potential for chat abuse.
If no one else can see the chat, then it would be too hard to regulate if someone says something. Also, negative feedbacks can result from chat abuse. Having to prove your case by taking a screenshot, posting it on an image hosting site and then linking it to here would be a PITA.

What about making private chat an option for non-tournament private games only. A warning would flash, saying that "private chat is not subject to abuse regulation", just in case someone is not clear.
Private games are between friends/family. This seems outside the realm of what CC should monitor. The worst that could happen if someone does abuse it is that you might put someone on your ignore list and/or, wind up with a negative feedback... but that is a risk you would take when implementing this option. Your choice. And, if you subject yourself more than once, well ... your problem.
I myself can see a lot of reasons for wanting this. Not just talking to family, but, well, some folks like to use language that I would consider quite offensive. (I mean something way above the "run of the mill" -- use your imagination). Keeping it private would be like ensuring your bedroom door is closed.

so is this a good Idea? sorta got left off as...nothing, You play PRIVATE games with ones you KNOW, you wouldn't leave a neg to someone you know, and I think you could have an option when you select private game, in start a game, another box Private chat could pop up as well, that way others know that it's private... I'd like to see this become an option, along with the other 5 family/friends I got on the site and the others on the site as well... that is along with another 20 improvements

2. I suspect the actual abuse rate is low, with the exception of the minority who consider abuse "fun" (read -- free choice -- no one HAS to participate). What is the greater harm - that one individual might not get treated as well as they like in a private game OR that the vast majority have to remember that chat is public, even in private games.
3. Placing someone on your ignore list is probably a better option than expecting CC to monitor PRIVATE games.
4. IF there is ever a serious exception -- hint of a real crime or something -- then I am sure the administration can retain read rights and act appropriately. (and this can be explicitly stated also, when someone checks this box) That doesn't mean the rest of us need to be involved. However, I am not sure that a case of that ever has or even ever will occur (in any proveable way anyhow).

If you are holding conversations in your game chat you don't want others to see, then perhaps you should be holding those conversations somewhere else? I don't know about the rest of you, but if I'm playing a game with a few friends or family members of mine, I'm never concerned that some person is going to say to themselves "Oh hey, let's go see what Optimus and his family are jabbering about. Perhaps we can make fun of him or something."
I have a feeling that the number of players who run around randomly looking at game chats is incredibly low, and so it really isn't an issue.
If you have set up a private game and given out the password you should be able to expect that the players involved don't need to have their chat hidden.

I'd actually be for a feature that lets you hide and block chat to non-game players (but not mods or admins for obvious reasons
).
Some people just want to play in peace but get harassed by trolls or stalkers and, as an option, there is very little reason not to facilitate that.

Me and my friend just use MSN messenger. It's alot better then the game chat and really simply to uses. I do like the idea of blocking non-game members.
