Uh, no. "Get em" isn't diplomatic discussions at all. You're allowed to talk about the game, just not about diplomacy.

eh, i don't think you clicked on the link to the screen shot, there is no real discussion of the game, just a playful "get em" thrown up in live chat. i believe the rule concerning discussion of games outside of games doesn't cover comments like, "man, he is kicking our ass!" or "red just crushed me with magic dice!!"... i interpret it as if Haas had made a more direct comment like, "we need to get <insert colour here>, he is taking over", that would be a violation... in live chat players frequently discuss games, and not in diplomatic means. that is part of the fun of CC... imagine how boring this place would be if we could not all go whine about our crappy dice in live chat and the forums (OK, REALLY BAD EXAMPLE)!! anyway, i don't think this even merits a warning because there was not any diplomatic discussion taking place within the live chat. the black jesus has spoken...-the black jesus

Had difficulties reading the screen shoots, but yeah, I'd say that one needs to discuss something tangiable that relates to game behavior in a game (outside the game's game chat) for it to be a rule # 2 violation.
