The 9% is really the exception, not the rule. The guidelines only give upper bounds for size limits because that is usually the boundary people have a problem with. Therefore if someone doesn't want to maximize the size of their map they could just try to make the large map the same dimensions as the small map. CC didn't want this, and hence the 9% mandatory increase was put in place.
On the other hand, if you are trying to maximize the size of your map, you might pick the maximum dimensions for the large and the small maps. In that case, the difference in size is ~25% on each linear dimension and ~44% difference in area
I've always felt the size restrictions on small maps made cartography exceptionally hard, especially for complicated ideas. For a while there was talk about hiding the menu bar on the left side and consolidating the action buttons to the right side. This would allow MUCH bigger maps, for both small in large. But it never happened and likely never will
