I think your reasoning is wrong.
You can't say a clan from the 2nd league can't go 1st league because he would be unable to beat the top clans of the 1st league. You should rather compare AFOS with clans ranked in the 2nd half of the 1st league. There I think they could compete.
TOP/ATN/PACK are in 2nd league this year but they are really 1st league level. The only reason they played the 2nd league is because they didn't participate last year.
I think, there is clans that could remain for a long time in the 1st league, clan that could promote/relegate every year, and some clans that will probably stay in 2nd league.
Promotion and relegation systems should be made to arbitrate which teams have a decent chance at surviving in the league. Having played MMM, AFOS and ID right before CL7 started and having played RET during CL7(alongside), I think any 4th place contender might be of comparable quality with the bottom teams in premier division. But that leaves a HUGE probability of relegating immediately.
Seriously, relegating 33% of the league every season is too many. It comepletely takes the fun out of the competition for bottom league teams if they realize there are so many relegation spots it will be nigh impossible for them to avoid. If you can't gain any fun out of competition, it's better to play individual clanwars. A 2-3 team promotion/relegation system like rockfist mentioned, seems a lot more reasonable.
