Accused:
Neptune1The accused are suspected of:
Other: Flaming within the C&A Forums, Violating Bigotry Guidelines,
Violating Admins Warning/Request (andy)Offending Post(s):
Neptune1 wrote:As for that knob head Owenshooter - what an ugly, weasel faced mother fucker he looks !! I had quite a laugh seeing that. Is he gay ???
Comments:
both myself and Neptune1 war warned to stay away from each other or we would be banned. i posted in a C&A thread concerning him, about my relevant and real experience with him. he responded with a flame and a homophobic slur within the thread. i hope he is dealt with. i know if i had openly flamed Neptune1, i would be on a vacation right now. it is time for this abusive player to have another time out. he has previously served time for flaming and abusive PM's directed towards me. and as i stated before, we were warned to stay away from each other. the above post is an obvious forum violation and violation of the ruling handed down to both of us by andy... thank you.-0
p.s.- i find it odd that within a C&A thread in which he is given a ratings ban for abuse and many posted about his abusive behaviour, he ends the thread with more abusive behaviour and forum violations:
Subject: Neptune1 - Continuous rating abuse [settled]

actually, technically speaking...
only the description of your appearance is a flame, and a completely uncalled for one at that.
the question, "are you gay?" however while obviously meant to be mean spirited is really just a question. Its even possible that the person himself is gay, and is simply curious if you are too.
He really is just asking if you are gay. And, unless you attribute something negative to being gay, there technically is nothing wrong with asking if you are. I fully agree, and would say ship him out, but the way he phrased it, it really isnt necessarily a homophobic slur, even though its probable that that is how he meant it.
He very well could just think you are ugly, and should be banned for flaming...but could on the other hand say he was just curious if you were gay, and not be suggesting that you are, or that there is anything wrong with you on that end, whether you are or not.
Im sure it was an accidental loophole, but if you really read it, its not necessarily homophobic.
But again, ship him for the other comments. Its well beyond the flaming, and im sure it wont be long before he slips again.
The problem with saying "are you gay?" is a homophobic statement, is that by itself, it would insinuate that being gay is wrong somehow, or some kind of insult, which, you need to have a homophobic stance in the first place to have.
Now, if he was talking about something other than just your face, and maybe some kind of behavior that could possibly have been attributed to what he would consider "gay" behavior, it would be crystal clear that he meant the question to be a slur. But as stated, he flames you for your appearance, which should get him banned right there.... but then simply asks if you are gay. Again, technically, anyone can ask anyone if they are gay. If we cant, it insinuates that if someone is gay there is something wrong or negative, and allows homophobia to win.
The best response to this is this. "Im sorry you dont like how I look. Nor do I care. Further, flaming is against the rules, and Im reporting you. And, I happen to be heterosexual. Why do you ask? Theoretically, you could probably ask, why, are you gay?" but it would probably be better not to.
You have to be careful what you call a homophobic slur or a racial slur. If you arent careful, you create one defacto by accident.
Anyone can ask me:
Are you asian?
Are you gay?
Are you catholic?
Its perhaps too personal a question and even rude...and probably even meant as a flame, but unless the statement before clearly leads into the said question, the question itself is harmless and really cant be regulated.
I will answer: no Im of irish descent, no, and not really, but I used to be.
Im interested to see other opinions on this, but Im pretty sure Im correct, at least on the correct side of a pretty gray area.
I hate that I kind of defended this guy, because I think the whole statement has no place here, but, I happened to see it from this angle.

PUHLEEEZE Owenshooter, that ain't no flame to be considered banning material. Aren't you one of the many who've complained about petty infractions receiving bans, of course you are.
Don't be a hypocrite and start pointing fingers at others, cause you got some "axe to grind" against some poster.

I think he's more going at, "This player has a history of abuse and banning, yet he can flame and get away with it? How come other people were banned for less..." but correct me if I'm wrong about that.

you all seemed to miss the biggest point, which is that neptune was told to avoid me, and i was told the same by andy... if he can violate that so freely, without repercussions, as we were promised as we were promised by andy, then where is the line with him? he was not making a blind or innocuous statements about a member he does not know. he was making a statement to a player whom he has sent abusive PM's, posted abusive game chat within games, and posted abusive garbage on his wall... throw in the false C&A accusations which i was cleared of, and the flaming is clear baiting.-0

Nah. I see where you're coming from, and I'm not gonna say that you're wrong. But as I recall, from owenshooter's point of view, such reasoning doesn't hold water.

I just think Fitz is being too technical about it. And that's something coming from me.

Develope a thick skin Owenshooter, this needs to be forgotten. We have all fought the battle to stop the b.s. bannings for minor infractions.
Just relax and have a beer or some other material to chill out.

Good point. A totally unnecessary statement of course and I'm not Neptune1's biggest fan, it wasn't exactly a huge deal this one I think.

Well, thats obvious, and I tried to make it obvious that I knew that. But I thought it was an interesting situation, and was interested to see what others thought.

Well, owen as I said a few times...im all for banning him for the flame against you...especially since he was warned to stay away from you.
I was only commenting on the bigotry accusation which was that asking the question, "are you gay" is homophobic. Its more for conversation, but really, I dont think it is.

we both shared a 1 week ban and were warned if we flamed or harassed one another again, it would be a month.. so, if i respond, i get banned... he was allowed to do what we were told not to do... that is my point.-0
p.s.-adjusted the title of the thread to show the most pressing and easily pressed points. thanks for your patience. additionally, it may have been Twill that gave him/us the warning, but i can not recall clearly. i do know that an
admin gave us the warning, which Neptune has violated.

This post is not homophobic. Just like if I said, "Is he Black."
The ugly, weasel faced mother fucker is just a childish comment, not worthy of Flame Wars.
C'mon Owenshooter, your skin is getting thinner by the day.

do you even read the previous posts before you post? perhaps you missed the last post on the prior page explaining it better.

you throw in a warning from an admin to stay away from each other, which he violated, and he should serve a time out. when ronc and i had our little misunderstanding, we both received additional time outs for violating the same order from andy. so, this should truly show if people are moderated differently. i know of several people that have been banned for violating admins requests to avoid another player, so why should Neptune1 be any different?-0
