The accused are suspected of: a rude picher in his info area( just above his wall). i dont know if you guy will care but it is not vary family friendly please check out this picher

As long as there is no revealing of "private parts" (ex.nipple), an avatar is not breaking any rules on CC
put the user on your foe list and don't click on his/her profile if you dislike his/her avatar

even with the removal of flame wars, CC has quite a liberal stance on what is allowed and what's not allowed
